NOTICE OF PRIVACY PRACTICES 

THIS NOTICE DESCRIBES HOW HEALTH INFORMATION MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. 

OUR PLEDGE REGARDING HEALTH INFORMATION 

We understand that health information about you and your health care is personal. We are committed to protecting health information about you. We create a record of the care and services you receive from our Clinic. We need this record to provide you with quality care and to comply with certain legal requirements. 

This Notice applies to all of the records of your care generated by this health care practice. This Notice will tell you about the ways in which we may use and disclose health information about you. We also describe your rights to the health information we keep about you, and describe certain obligations we have regarding the use and disclosure of your health information. 

HOW WE PROTECT YOUR HEALTH INFORMATION 

Treating all of your protected health information (PHI) we collect as private and confidential. 

Restricting access to your health information only to those staff who need to know your health information in order to provide and facilitate services to you. 

Only disclosing your health information that is necessary for an external service company to perform its function on our behalf, and the company has by contract agreed to protect and maintain the confidentiality of your health information. 

Maintaining physical, electronic, and procedural safeguards to comply with regulations and standards guarding your health information. 

Providing you this Notice of our duties and privacy practices with respect to health information. Following the terms of the Notice that is currently in effect. 

USE AND DISCLOSURES OF YOUR HEALTH INFORMATION 

We will use and disclose health information about you for treatment, payment, and healthcare operations. For example: 

Treatment, Payment or Healthcare Operations. We may use and disclose your personal health information to carry out the health care providerʼs own treatment, payment, or health care operations. We may disclose PHI for our use in training or supervising health practitioners to help them improve their skills in group, joint, family, individual counseling or therapy, or medical treatment. We may also disclose your protected health information for the treatment activities of any relevant health care provider. Disclosures for treatment purposes are not limited to the minimum necessary standard. Because health care providers need access to the full record and/or full and complete information in order to provide quality care. The word “treatment” includes, among other things, the coordination and management of health care providers with a third party, consultations between health care providers and referrals of a patient for health care from one health care provider to another. 

Your Authorization. In addition to our use of your health information for treatment, payment, or healthcare operations, you may give us written authorization to use your health information or to disclose it to anyone for any purpose. If you give us an authorization, you may revoke it in writing at any time. Your revocation will not affect any use or disclosures permitted by your authorization while it was in effect. Unless you give us a written authorization, we cannot use or disclose your health information for any reason except those described in this Notice. 

To Your Family, Friends and Third Party Private Payers. We must disclose your health information to you, as described in the Patient Rights section of this Notice. We may disclose your health information to family, friends, or other persons that are involved in your care or the payment for your healthcare, unless you object in whole or in part. The opportunity to consent may be obtained retroactively in emergency situations. In the instance of couples or family therapy, We require mutual authorization of all parties in order to fulfill a request to release any records. This is designed to protect the confidentiality of all parties. 

Persons Involved in Care. We may use or disclose health information to notify, or assist in the notification of (including identifying or locating) a family member, your personal representative, or another person responsible for your care, of your location, your general condition, or death. If you are present, then prior to use or disclosure of your health information, we will provide you with an opportunity to object to such uses or disclosures. In the event of your incapacity or emergency circumstances, we will disclose health information based on a determination using our professional judgment disclosing only health information that is directly relevant to the personʼs involvement in your healthcare. We will also use our professional judgment and our experience with common practice to make reasonable inferences of your best interest in allowing a person to access health information. 

Marketing Health-Related Services. We will not use your health information for marketing without a written authorization from you. 

Required by Law. We may use or disclose your health information when we are required to do so by law, including, but not limited to, court or administrative orders, subpoenas, discovery requests, or other lawful processes, although our preference is to obtain an Authorization from you before doing so. We may disclose information for law enforcement purposes, including reporting crimes occurring on our premises. For workers’ compensation purposes. Although our preference is to obtain an Authorization from you, we may provide your PHI in order to comply with workers’ compensation laws.

 

Public Health Activities. We may disclose your health information to appropriate authorities if we reasonably believe that you are a possible victim or perpetrator of abuse neglect, or other crimes. We may disclose your health information to the extent necessary to avert a serious threat to the health or safety of you or others. 

Specialized Government Functions. We may disclose to military authorities the health information of Armed Forces personnel under certain circumstances. We may disclose to authorized federal officials health information required for lawful intelligence, counterintelligence, and other national security activities. We may disclose health information to a correctional institution or law enforcement official having lawful custody of health information of an inmate or patient under certain circumstances. 

Appointment Reminders and Services. We may use and disclose your PHI to contact you to remind you that you have an appointment with us. We may also use and disclose your PHI to tell you about treatment alternatives, or other health care services or benefits that we offer. 

Research. Under certain limited circumstances, we may use and disclose health information about you for research purposes. All research projects, however, are subject to a special approval process through an appropriate Institutional Review Board (IRB). 

Selling Health Information. We will not sell your health information. 

YOUR RIGHTS REGARDING THE USE AND DISCLOSURE OF YOUR HEALTH INFORMATION You have the right to request all of the following: 

Access to Your Health Information. You have the right to request a copy of your health information. A nominal fee may be charged for providing copies. However, this right does not include the following types of records: psychotherapy notes; records compiled in reasonable anticipation of a court action or administrative action or proceeding; and health information whose release is prohibited by federal or state laws. Access to your records may also be limited if it is determined that by providing the information it could possibly be harmful to you or another person. If access is limited for this reason, you have a right to request a review of that decision. We will provide you with a copy of your record, or a summary of it, if you agree to receive a summary, within 30 days of receiving your written request, and we may charge a reasonable, cost based fee for doing so. 

The Right to Amend or Update Your PHI. If you believe that there is a mistake in your PHI, or that a piece of important information is missing from your PHI, you have the right to request that we amend the existing information or add the missing information. We may say “no” to your request, but we will tell you why in writing within 60 days of receiving your request. Amending a record does not mean that any portion of your health information will be deleted. 

The Right to Request Limits on Uses and Disclosures of Your PHI. You have the right to ask us not to use or disclose certain PHI for treatment, payment, or health care operations purposes. We are not required to agree to your request, and we may say “no” if we believe it would affect your health care.

The Right to Request Restrictions for Out-of-Pocket Expenses Paid for In Full. You have the right to request restrictions on disclosures of your PHI to health plans for payment or health care operations purposes if the PHI pertains solely to a health care item or a health care service that you have paid for out-of-pocket in full. 

The Right to Choose How We Send PHI to You. You have the right to ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address, and we will agree to all reasonable requests. 

CHANGES TO THIS NOTICE 

We reserve the right to change the terms of this Notice, and such changes will apply to all information we have about you. The new Notice will be available upon request and on our website. You have the right get a paper copy of this Notice, and you have the right to get a copy of this Notice by e-mail. And, even if you have agreed to receive this Notice via e-mail, you also have the right to request a paper copy of it.
